B. No Mechanic-Client Relationship Use of the Service does not create a licensed automotive technician, mechanic, or legal relationship. AutoCalculated IQ is an analytical tool and decision-support assistant—not a certified automotive repair facility or physical diagnostic shop. C. Repair Decisions & Vehicle Safety Warning User Responsibility: You are solely responsible for all final decisions made regarding the maintenance, repair, or operation of your vehicle. Critical Safety Systems: While the Service assists in identifying non-essential upsells, you acknowledge that ignoring or declining repairs recommended by a certified shop (especially concerning brakes, steering, suspension, tires, airbags, or engine management) can result in severe vehicle damage, accidents, bodily injury, or death. Always consult a certified ASE technician to perform physical inspections.

Pricing Accuracy: Price benchmarks within a 15-mile radius are generated from historical, regional, and statistical shop data. Actual shop pricing, labor rates, and parts availability may vary based on market fluctuations. We do not guarantee that any individual repair facility will match, accept, or honor the estimated prices or negotiation scripts generated by the app. AI Service Advisor Output: Artificial intelligence features process user-provided inputs and uploaded quote images. AI-generated outputs may contain errors, inaccuracies, or incomplete information. BK Automotive Solutions LLC assumes no liability for repair decisions made based on AI-generated scripts or guidance.

The "Fix vs. Trade-In" feature (including the 60% repair-cost-to-market-value threshold) utilizes third-party live market valuation estimates and algorithmic models. These thresholds are recommendations only. BK Automotive Solutions LLC does not guarantee actual cash trade-in offers, wholesale valuations, or dealership trade values.

AutoCalculated IQ acts solely as an informational interface and dispatch request portal for third-party roadside assistance and towing providers. Independent Contractors: All roadside operators, tow truck drivers, and mechanics dispatched through the Service are independent third-party contractors and are not employees, agents, or subcontractors of BK Automotive Solutions LLC. No Towing Liability: BK Automotive Solutions LLC expressly disclaims any liability for: • Delays, missed dispatches, or lack of towing availability in your geographic area. • Vehicle theft, property damage, personal injury, or accidents occurring during loading, transit, or roadside service. • Additional fees levied by independent towing companies or impound facilities.

Subscription Terms: Access to certain features (including the Pro Advisor Family plan) requires a paid subscription. Subscriptions automatically renew at the specified frequency unless cancelled prior to the renewal date. Family Vehicle Caps: Standard Family Plans permit up to 4 registered vehicles. Additional vehicle add-ons are subject to separate monthly fees. Savings Counter: The "Savings Tracker" displays estimated user savings based on user-entered data and market averages. Displayed savings do not constitute monetary credits or cash balances payable by BK Automotive Solutions LLC.

All content, software, text, graphics, logos, and proprietary price-calculation algorithms are the exclusive property of BK Automotive Solutions LLC and are protected by United States and international copyright, trademark, and trade secret laws. Prohibited Actions: You agree that you will not reverse-engineer, decompile, crawl, scrape, or extract pricing data, database records, or AI prompt architectures from the Service for commercial or competitive purposes.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BK AUTOMOTIVE SOLUTIONS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, VEHICLE DAMAGE, ACCIDENTS, OR TOWING CHARGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in the Northern District of California.

A. License Grant BK Automotive Solutions LLC grants you a limited, non-transferable, non-exclusive, non-sublicensable license to download, install, and use the AutoCalculated IQ application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. B. No Apple Relationship You acknowledge and agree that this End User License Agreement (EULA) is concluded between you and BK Automotive Solutions LLC only, and not with Apple, Inc. ("Apple"). BK Automotive Solutions LLC, not Apple, is solely responsible for the AutoCalculated IQ Service and the content thereof. C. Maintenance & Support BK Automotive Solutions LLC is solely responsible for providing any maintenance and support services with respect to the Service, as specified in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service. D. Subscription Management Subscriptions purchased through the Apple App Store are managed by you. You can manage or cancel your subscription at any time by going to your Apple ID Account Settings on your device. Cancellations must be made at least 24 hours before the current billing period ends to avoid being charged for the next period. E. Apple's Rights This EULA is subject to Apple's then-current App Store terms. Apple is a third-party beneficiary of this EULA, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
